Terms of Sales
1. Preamble
The Parresia Group, a simplified joint-stock company with a capital of 1,100,000 euros, registered in the Trade and Companies Register of Paris under number 837 734 318, headquartered at 23 rue du Docteur Lannelongue – 75104 Paris, offers current medical content on its website www.audiology-worldnews.com (hereinafter referred to as the Website) as well as a magazine subscription service. This service is subject to these General Terms and Conditions (hereinafter: GTC), to the exclusion of all other documents or conditions. Any consultation of the Website and any subscription made via the Website requires the full and unconditional acceptance of these GTC by the user (hereinafter “User” or “Customer” or “Internet User”).
Parresia reserves the right to modify the GTC at any time. The new GTC will be brought to the attention of the customer, if necessary, by online modification and will only apply to sales made after the modification.
The GTC are subject to French law. In the event of a dispute, only the French courts shall have jurisdiction.
2. Setting up an Account on the Website
Certain products and/or services accessible through the Website require the user and/or customer to set up an account.
Only one account may be set up per user and/or customer.
Setting up an account is a declarative procedure that allows the user and/or customer to enter a series of information about themselves so that they can be associated with the access rights they hold for all or part of the products and/or services of the Website. The account is linked to access codes, i.e., a username and password chosen by the user and/or customer, enabling them to identify themselves on the Website, connect to their account, and use the associated products and/or services. The user and/or customer undertakes to provide accurate and complete information when setting up their account and to keep this information up to date throughout the validity of their account.
These access codes are personal and confidential. Each user and/or customer acknowledges and accepts that any connection to the Website, use of a product and/or service, and any order made via their account shall be deemed to have been made by them.
The user and/or customer undertakes to keep their access codes confidential and not to disclose them to any third party. They are also encouraged to log out after each visit to the Website and/or applications.
For security reasons, the provider reserves the right to send the user a request to reset their account if unusual usage is detected on an account. If the problem persists, the subscription will be suspended, and the user will be asked to switch to a corporate subscription offer.
3. Subscription
These General Terms and Conditions apply to all products distributed by www.audiology-worldnews.com.
The various subscription offers are offered within the available stocks. The valid offers are those displayed on the day of registration of the order on the Website, www.audiology-worldnews.com, and reserves the right to change them at any time.
In the case of a subscription for an indefinite period, paid by direct debit, Parresia may change the amount regularly charged for the subscription or the new subscription. In this case, Parresia must inform the user in advance, within a period allowing the user to terminate their subscription at their request before the actual implementation of this change.
Parresia reserves the right to change offers at any time, propose new offers, and offer specific promotional offers on the Website.
A single subscription grants access to all content and related services on the Website www.audiology-worldnews.com for the duration of the subscription. To avail of this access right, the subscription must have been taken out as a single subscription.
By purchasing online products and using the services offered, the customer declares that they are using the services of www.aaudiology-worldnews.com in accordance with applicable law and these General Terms and Conditions.
Parresia may revise prices for subscription contracts. The price is guaranteed for the entire ongoing contract period.
For any price increase not provided for at the time of ordering, Parresia will inform the customer of the price increase at least one month before it takes effect. Upon receipt of this notification, the customer may freely terminate their subscription. If no termination occurs within the set deadline, the tariff change is deemed accepted and applied to the continuation of the contract.
4. Subscription Terms
The contract information is the subject of confirmation, listing this information at the time of the online purchasing process.
Parresia reserves the right to cancel any order from a customer with whom there is a payment dispute, without the customer being entitled to compensation for any reason.
The confirmation of the order by the customer constitutes full and unconditional acceptance of these General Terms and Conditions. The data stored on the Website www.audiology-worldnews.com constitutes proof of all transactions between Parresia and its customers, whether these transactions were carried out directly or indirectly (through a third party).
The data stored by the payment system constitutes proof of financial transactions. To confirm their order, the customer must click on the “Subscribe” button at the end of the ordering process.
A confirmation of the subscription will be sent to the email address provided immediately and will include contractual information, in particular the exact invoice amount and the terms of the offer. This subscription confirmation constitutes acceptance of the order and confirms the transaction.
The customer acknowledges that the data stored on the Website constitutes proof of the transaction (type of subscription and date of conclusion), and the data stored by the payment system constitutes proof of the financial transaction.
5. Payment
The valid prices of the various subscription and new subscription offers are those displayed on the Website on the day of registration of the order, with Parresia reserving the right to change these prices at any time.
All orders, regardless of their origin, are payable in euros. Promotional offers are only valid for the duration of the relevant offer and for any initial subscription. Ongoing special offers cannot be combined with each other. They cannot be exchanged for their monetary value or partially or fully refunded. After the expiry of the specified period, the discount is definitively lost.
The customer is solely responsible for the actual payment of the purchased product, which is paid once by credit card, by check, or in one or more installments by direct debit from their account. Only the user is responsible for payment by credit card, by check, or by direct debit for the service offered. Parresia is not responsible for payment problems related to the operation of the e-commerce service.
The customer acknowledges that they must pay the entire price and all costs associated with the purchased product, including taxes.
6. Withdrawal
In accordance with Articles L121-21 et seq. of the French Consumer Protection Code, you have a right of withdrawal, which entitles you to cancel your order placed over the Internet within 14 (fourteen) full days from the receipt of the first issue of the newspaper or from the date of registration of your order for digital services. If this period normally expires on a Saturday, Sunday, or a legal or public holiday, it shall be extended until the next working day.
Cancellation of an order results in the cancellation of the subscription.
7. Shipping
The paper magazines are sent and delivered by post to the address provided during the ordering process, provided that the customer provides accurate information and supplies all the necessary information for the proper shipment of their order.
The delivery times and deadlines are those usually practiced by postal services, with Parresia assuming no liability for defects and/or delays in the transportation of magazines caused by complete or partial malfunction of the postal service.
No reshipment will be made in the event of non-receipt of the magazines. However, upon reasonable, justified, and timely request from the subscriber, Parresia may resend an issue of the publication that was not received or was damaged, subject to availability.
8. Liability and Personal Data
Parresia provides its services within the framework of the publication of a website and subscription and new subscription contracts in accordance with applicable French regulations. Parresia cannot be held liable for non-compliance with the legislation of another country.
The customer uses Parresia’s services at their own risk. Parresia cannot guarantee under any circumstances that the services offered will not be interrupted. The obligation to provide the magazines is limited to a best effort obligation.
Parresia cannot be held liable for the non-performance of the contract if the product is out of stock or unavailable, if force majeure, malfunctions, interruptions, or total or partial strikes occur, especially of postal services and transportation and/or telecommunications means.
Parresia is not liable for indirect damages resulting from these terms and conditions, such as loss of business, loss of profits, loss of opportunities, damages, or costs.
Under no circumstances shall Parresia be liable to the user for indirect damages, consequential damages, special damages, incidental damages, deterrent damages, loss of information, or problems with electronic payment, costs of delay, or procurement of substitute products or services, regardless of the cause, based on a liability theory (including formal, contractual, tortious, consequential damages within the legally permissible framework, and damages caused by negligence) arising out of this contract. These limitations apply even if a party has been advised of the possibility of such damages and notwithstanding any failure of the essential purpose of any limited remedy.
In accordance with the provisions of the Law of January 6, 1978 on Data Files, Computers, and Liberties, Parresia’s customers have the right to access, rectify, and object to personal data concerning them. This right can be exercised by sending an email to info@audiology-worldnews.com.
